This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and PS Signature Guitar Company (“Company,” “we,” or “us”) governing your use of any software, digital content, firmware, or services provided or made available by the Company, whether bundled with a physical product or distributed digitally (collectively, the “Licensed Product”).
By purchasing, downloading, installing, or using the Licensed Product, you agree to be bound by this Agreement.
1. Grant of License
The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the Licensed Product for personal, non-commercial purposes, subject to the terms of this Agreement.
2. Restrictions
You may not:
- Modify, reverse engineer, decompile, or disassemble the Licensed Product.
- Sell, rent, lease, sublicense, or distribute the Licensed Product.
- Remove or alter any copyright, trademark, or proprietary notice.
- Use the Licensed Product in a way that violates applicable laws or regulations.
3. Ownership
The Licensed Product is licensed, not sold. All rights, title, and interest in and to the Licensed Product, including all copyrights, patents, trademarks, and trade secrets, are owned by PS Signature Guitar Company or its licensors.
4. Updates and Support
The Company may, but is not obligated to, provide updates or support for the Licensed Product. Any updates will be subject to the terms of this Agreement unless accompanied by a separate license.
5. Termination
This Agreement is effective until terminated. You may terminate it at any time by uninstalling and ceasing all use of the Licensed Product. The Company may terminate this Agreement if you fail to comply with any term herein. Upon termination, you must destroy all copies of the Licensed Product.
6. Disclaimer of Warranties
The Licensed Product is provided “as is” and “as available” without warranty of any kind. The Company disclaims all warranties, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, PS Signature Guitar Company shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising from or related to your use of the Licensed Product.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
9. Entire Agreement
This Agreement constitutes the entire agreement between you and the Company concerning the Licensed Product and supersedes all prior or contemporaneous communications.
